- November 2004 - INECE Participation at IUCN Judiciary
Day during the World Conservation Congress
The INECE Secretariat delivered remarks to leading judges
and environmental law practitioners at IUCN's Judiciary
Day on 16 November. The program analyzed and showcased the
role of the judiciary in upholding the rule of law, focusing
on the role of judges with respect to the links between
environment, human rights, and poverty. The Secretariat's
presentation, entitled "Promoting
the Judiciary in Environmental Compliance and Enforcement,"
demonstrated the critical role of judges in bringing about
a a stronger and more global rule of law, and with it, a
heightened ability to curb the excesses of globalizationincluding
excesses of pollution, excesses from natural resource exploitation,
and other adverse environmental impacts.
The presentation highlighted INECE's work to strengthening
both cross-boarder and internal domestic cooperation between
judges and environmental enforcement practitioners, including
INECE's project on comparative judicial remedies, to show
how judges around the
world remedy the environmental violations found in their
societies. The project ultimately will provide comparative
data on penalty policies, and a penalty calculator
tool built on the best practices of judges and regulators
from around the world.
- October 2004 - UNDESA Announces Workshop on National
Sustainable Development Strategies in the Arab Region
This by-invitation workshop is intended to contribute
to advancing the goal of implementing national sustainable
development strategies by the year 2005 as stated in the
Johannesburg Plan of Implementation (JPOI). The workshop
is addressed to senior officials from the Arab region with
responsibilities related to sustainable development. It
is being hosted by the Government of Egypt and organized
by the United Nations Department of Economic and Social
Affairs (UNDESA) in cooperation with the United Nations
Economic and Social Commission for West Asia (UNESCWA) and
in co-ordination with the United Nations Development Programme
(UNDP). The final report of the workshop will be posted
on the Division's website.

September 2004 - 'Judiciary
Day' to be held during IUCN World Conservation Congress
The IUCN Commission on Environmental Law has created
a Specialist Group on the Judiciary, Chaired by the Hon
Justice Paul Stein AM. The Commission and Specialist Group,
with the support of the IUCN Environmental Law Centre, will
be holding a major event on 16-17 November 2004 during the
IUCN World Consrevation Congress to showcase the role of
the judiciary in upholding the rule of law, focusing on
the role of judges with respect to the environment, human
rights and poverty. A draft

- 30 August 2004 - South
Africa to Hold Johannesburg +2
In 2002, South Africa successfully hosted the World
Summit on Sustainable Development, enabling the world to
negotiate a plan and set targets that would shift the world
onto a sustainable growth path. The Johannesburg +2 Conference,
scheduled to be held on 1-4 September 2004, will commemorate
the WSSD and assess South Africa's progress towards acheving
the goals set in the Plan of Implementation.

from UNEP's Environmental Law Programme
The European Union Forum of Judges for the Environment
was created at a meeting held at the European Court of Justice
in Luxembourg on 26 April 2004. Its President, Justice Guy
Carnivet, announced at the meeting that this action was
a direct result of the UNEP Global Judges Symposium held
in Johannesburg on the eve of the World Summit on Sustainable
Development and the planning meetings held in Nairobi in
January of 2003 for the implementation of the outcomes of
the Johannesburg Symposium.
UNEP convened Regional Chief Justices Needs Assessment and
Planning Meetings on 29-31 May in Cairo, the English speaking
Caribbean Chief Justices Meeting for 11-12 June in Trelawny,
Jamaica, and will hold the Francophone West African Chief
Justices Meeting in October in Dakar.
- 20 June 2004 - OECD to Publish Proceedings of Indicators
Expert Workshop
The Organisation for Economic Co-operation and Development
will publish the Proceedings of the INECE-OECD Expert Workshop
on Environmental Compliance and Enforcement Indicators:
"Measuring What Matters," held in Paris, France,
in November 2003. The INECE Indicators project seeks to
identify key measures of the effectiveness and efficency
of environmental enforcement programs to help practioners
improve program development and focus resources. The proceedings

- 30 May 2004 - World
Bank Institute Announces Forthcoming Publication on Compliance
and Enforcement in Japan

The forthcoming (mid-2004) WBI publication, "Local
Approaches to Local Approaches to Environmental Compliance:
Environmental Compliance: Japanese Case Studies and Lessons
for Developing Countries," addresses the rise of costly
environmental problems due to rapid industrial and urban
expansion in developing countries demands sound management
interventions. Though technological improvements clearly
play an important role in addressing environmental problems,
institutional coordination, economic incentives, and local
involvement are also critical in this process. The publication
is edited by INECE EPC member Adriana Bianchi, Wilfrido
Cruz, and Masahisa Nakamura. Visit WBI's

- 30 April 2004 - Conclusions
from the 12th Session of the Commission on Sustainable Development
CSD-12 concluded on 30 April. IISD's summary and conclusions
document notes, "The first three days of CSD-12 (14-16
April) served as the preparatory meeting for the International
Meeting on the 10-year Review of the Programme of Action
for the Sustainable Development of Small Island Developing
States. The subsequent two weeks (19-30 April) were devoted
to the CSD-12 Review Session, the first session held under
the Commissions new multi-year programme of work adopted
at CSD-11....A unanimous verdict was passed on the success
of CSD-12: it produced a clearer picture on the progress
of implementation and the actions needed to increase the
pace of delivery; it provided the space for ministers to
look at progress, identify challenges, constraints and obstacles
without the need to battle over drafting formulas; and it
reaffirmed political commitment to achieving the internationally-agreed
goals and targets on water, sanitation and human settlements."
- 15 March 2004 - Indicators
of Sustainable Development
Indicators for monitoring progress towards sustainable
development are needed in order to assist decision makers
and policy makers at all levels and to increase focus on
sustainable development. Indications of economic, social,
environmental, and institutional well-being have been developed
within the framework of the Commission
on Sustainable Development for use by all countries.
INECE is developing a related
set of indicators to measure levels environmental compliance
and enforcement.
- 25 February 2004 - CSD-12
Preparations Underway
The Commission on Sustainable Development met in New
York in February to prepare for the upcoming CSD-12 meeting
which will be held in April 2004. As the beginning of the
first 2-year cycle, the CSD-12 Review Session will focus
on the thematic cluster of water, sanitation, and human
settlements.
- 10 January 2004 - New
Online Library of Civil Society Documents Produced for the
WSSD
The International Institute for Environment and Development
(IIED) and the Northern Alliance for Sustainability (ANPED)
have released an online library of documents produced by
civil society for the WSSD.
- 10-12 November 2003 - Global
Conference on Oceans, Coasts, and Islands: Mobilizing for
Implementation of the Commitments Made at the 2002 World
Summit on Sustainable Development - This conference
hopes to develop implementation strategies and recommendations
for the important targets established on issues related
to small island developing states (e.g., developing community-based
initiatives in sustainable tourism by 2004); on fisheries
issues (e.g., managing fishery capacity by 2005 and controlling
illegal fishing by 2004), and in other ocean-related areas
at the WSSD. For

- 16-18 September 2003 - Workshop
on Governance for WSSD Implementation Develops Recommendations
- IISD reports that the State Planning Organization of Turkey,
with assistance from the UN Department of Economic and Social
Affairs (UN/DESA), hosted a workshop on Governance
for the Implementation of the Outcomes from the World Summit
on Sustainable Development (WSSD) in Countries with Economies
in Transition. Eighty individuals from 24 countries
worked together to develop the workshops recommendations
to help improve governance structures for implementing the
WSSD outcomes. Recommendations included calls to increase:
awareness of sustainable development, transparency of decision-making
processes, and engagement of civil society in the implementation
process.
- 25 August 2003 - The Tagaytay
Declaration of Commitment
to the use of law for environmental protection was developed
by participants at a recent Judges Forum on Environmental
Protection, held in the Philippines. The meeting was a follow-up
to the Manila Judges Symposium of 1999 and is related to
ongoing work of the role of the judiciary in achieving sustainable
development.

July 2003 - In May, senior judges from 11 countries
of Central/Eastern Europe, Caucasus and Central Asia, together
with other judges and experts from across the globe, met
in Lviv, Ukraine to advance the Johannesburg Plan of Implementation,
insofar as it relates to the role of the judiciary in achieving
sustainable development. The conference program considered
regional and comparative case studies, together with issues
relating to the Aarhus Convention, human rights and environment,
constitutional environmental rights, the potential role
of specialist environment courts, and the ability of judges
to exchange judgments through the IUCN/UNEP Judicial Portal.

- May
2003 - The
Rome Statement
was released following a meeting of European Judges in May
to discuss the Johannesburg Plan of Implementation. Specific
outcomes included the first meeting of the European Judges
Forum and the IUCN CEL Judicial Specialist Group, further
support for the IUCN/UNEP Judicial Portal and consideration
of the content of the UNEP Judges Handbook.
- The UN
Division for Sustainable Development continues to
update its home page with information about follow-up meetings
to the WSSD and activities of the Commission on Sustainable
Development.
- European Judges Symposium outlined initial steps
in advancing the implementation of the World Summit on Sustainable
Development Johannesburg Plan of Implementation, insofar
as it relates to the role of the judiciary in achieving
sustainable development. The text of the "London

Role in the World Summit on Sustainable Development
and its Outcomes:

Increased
Enforcement Required to Meet Targets and Timetables
Set
at the World Summit on Sustainable Development
|
The World
Summit on Sustainable Development, held in Johannesburg, South
Africa from 26 August to 4 September, recommitted the governments
of the world to implementing the Rio Principles and the full
scope of Agenda 21. The official goal of the Summit was not
to establish new principles, commitments, or institutions,
but rather to review progress towards the existing principles
and commitments set at the 1992 UN Conference on Environment
and Development (also known as the Rio Earth Summit).
The World
Summit set specific targets and timetables for several critical
issues, including biodiversity loss, access to water and sanitation,
fishery yields, and chemicals. The targets are outlined in
two substantive documents which were developed at the World
Summit: The
Johannesburg Declaration on Sustainable Development and
the Plan
of Implementation. Other outputs from the Summit include
proceedings and action plans set for in numerous side events
which took place in and around Johannesburg. INECE was an
active participant in several side events.
Many of
the Summit commitments, particularly regarding biodiversity,
chemicals, and fisheries, set forth for the first time, targets
and timetables that present a tremendous challenge for those
responsible for implementing the Rio commitments and enforcing
environmental law and policy. To assist in meeting this challenge,
INECE announced at the Summit that it was launching the INECE
Enforcement Indicator Project to develop a set of indicators
to measure and manage enforcement and compliance efforts.
In addition to assisting countries manage their enforcement
resources for improved performance; INECE plans to use the
indicators to identify opportunities to expand its training
and capacity building program. Other strategies for helping
enforcement practitioners meet the targets and timetables
set by the Summit are being considered in the development
of the 2003-05 INECE strategic plan.

Summit 2002: Environmental Law Foundations for Sustainable
Development
This
Conference, hosted by the IUCN and Institute of Environmental
Law at the University of Natal, was held on 20-22 August
at the University of Natal in Pietermaritzburg, South
Africa. The Conference took stock of the strengths and
weaknesses of environmental law as we enter the 21st century,
assessed the practical measures that need to be taken
at the UN World Summit for Sustainable Development, and
scoped out the future agenda for legal measures essential
to attaining sustainable development. |

Conference 2002: Law and Governance for a Sustainable
Society
The
EnviroLaw Conference was held in
Durban,
South Africa on 22-25 of August. The Conference focused

role of sustainable development law and environmental
justice, finance and trade; the linkages between policy
and practice; and the frameworks for more effective mechanisms

The Summit Institute for Sustainable Development provided
an opportunity for experts to hold mini-courses on key
sustainable development issues. INECE representatives
developed and held a workshop entitled "Citizen Participation
in Environmental Policy and Enforcement" on August
