Outcomes of Symposium of Judges and Prosecutors of Latin America
Fundación Ambiente y Recursos Naturales (FARN) released the proceedings from the 2nd International Conference on Environmental Compliance and Enforcement in Latin America. Topics include training, justice and civil society, organization of the judicial branch in light of the content of environmental issues, the role of judges and prosecutors in environmental enforcement and compliance, constitutional processes, environmental damage, and many others. Chilean Sea Bass Smugglers Flooding Markets with Illegal Catch
Federal authorities along the West Coast have seized more than 600,000 pounds of suspected illegal Chilean sea bass in recent weeks, a US$10 million haul that environmentalists say reflects a thriving black market trade in the delicate, tasty fish. Illegally caught and often routed through more friendly foreign markets to disguise its origin or capture, the high-priced delicacy is a popular target for pirates in the South Pacific and Antarctic oceans. As a result, stocks are dwindling.
The National Environmental Trust blames regulation loopholes, sophisticated smuggling techniques, and overburdened border enforcement for the illegal trade.
Andy Cohen, who heads the National Oceanic and Atmospheric Administration northeast enforcement office, said that increased enforcement has taken a bite out of the illegal toothfish trade, but it remains a major problem.

US EPA fines Arizona fertilizer company for Clean Air Act violations
The U.S. EPA has fined a Arizona fertilizer company, Apache Nitrogen Products, Inc., $40,000 for emitting high levels of nitrogen oxide during frequent startups at two of its units near Benson, Arizona between 1999 and 2002.
The facility's nitrogen oxide emission's during plant startup were often more than 1,000 parts per million. Normal operation emissions are typically less than 200 parts per million. Facilities subject to the federal New Source Performance standards are required to minimize emissions at all times, including plant startups.

Enforcement Action Against DuPont For Toxic Substances Reporting Violations
US Environmental Protection Agency (USEPA) is taking an administrative action against DuPont for two violations of the Toxic Substances Control Act (TSCA) and one violation of the Resource Conservation and Recovery Act (RCRA). These violations consist of multiple failures to report information to USEPA about substantial risk of injury to human health or the environment from the synthetic chemical Perfluorooctanoic Acid (PFOA).

CCAD announces support for compliance with
CITES
15 June - A recent workshop hosted by the Comisión
Centroamericana de Ambiente y Desarollo (CCAD) brought together interested
stakeholders to discuss the difficulties in combating illegal trade
in endangered species and to identify solutions. Participants agreed
that improvements should be made in inter-agency, inter-country, and
regional cooperation, particularly in regards to information sharing
and for harmonizing laws to prosecute offenders. See the CCAD Web

Becerra and Guillermo Espinoza have released a new book entitled Gestión
ambiental en América Latina y el Caribe. Evolución Tendencias
y Principales Prácticas. (Environmental Management in Latin
America and the Caribbean: Evolution, tendencies, and main practices).
The book is published by the Inter-American Development Bank (IADB).
The book is available in Spanish and a summary
(Spanish) is available here. The book is available for downloading

- Symposium of Judges and Prosecutors in Latin America
The objective of the Symposium was to elaborate an action plan and
to make specific proposals, regarding the necessities and interests
at national and regional levels, towards the strengthening of judges
and prosecutors' role on environmental law in Latin America. More
than 60 Judges and Prosecutors from Latin America signed the Buenos
Aires Declaration in which they showed their conviction of the relevant
role the judges and prosecutors play on the effective environmental
law enforcement in order to achieve sustainable development in the

- CEC Council orders factual record on Canada's enforcement of federal
pulp and paper effluent regulations
On
11 December 2003, the Commission for Environmental Cooperation of
North America (CEC) instructed the CEC Secretariat to prepare a
factual record on allegations that Canada is failing to effectively
enforce section 36(3) of the Fisheries Act and federal Pulp and
Paper Effluent Regulations (PPER) at ten pulp and paper mills in
Quebec, Ontario and the Atlantic provinces. The
allegation, which was filed by Sierra Legal Defense Fund (SLDF),
is available from CEC.

EPC Member Adriana Bianchi is leading the effort to organize a meeting
of the South American Regional Network in Buenos Aires, Argentina
on September 22-23. The event will involve capacity building programs
for the judiciary in several South American countries and a half-day
workshop on compliance and enforcement indicators in preparation for
South American participation in the INECE-OECD Indicators Workshop
in Paris.

Chile's Environmental Legal Defense System
The newly established Centro Austral de Derecho Ambiental (CEADA)
in southern Chile's Region 10 is taking the leadership to provide
environmental defense in public interest cases. CEADA was created
to defend the natural resources of southern Chile. For more information,

Success in Mexico
The Executive Director of the CEC recently highlighted the success
of an initiative to eliminate use of the persistent organic pollutant
DDT. The Mexican DDT initiative brought together two communitiesthe
health policy community and the environment communitywho share
similar concerns but rarely come together to address them, said CEC
Executive Director Janine Ferretti, speaking at the meeting of the
Health and Environment Ministers of the Americas in Ottawa.
