New UN Finance Initiative Report: Show Me the Money
  August 2006 - Show Me The Money: Linking Environmental, Social and Governance Issues to Company Value PDF icon confirms the growing importance of environmental, social and governance (ESG) concerns to the global investment industry. The report was launched by UNEP's Finance Initiative, in cooperation with 14 of the world's largest investment companies.
UNEP Publishes Manual on Compliance with and Enforcement of MEAs
  July 2006 - The Manual on Compliance with and Enforcement of MEAs PDF icon aims to strengthen the capacity of governments to implement and enforce MEAs and to comply with environmental law more broadly, facilitating the use and application of the UNEP “Guidelines on Compliance with and Enforcement of Multilateral Environmental Agreements. The Manual provides specific examples from around the world on how governments, NGOs, the private sector, and other institutions have utilized the various approaches to ensuring compliance and enforcement.
INECE Congratulates Romina Picolotti on her New Position as Head of Argentina's Environment Secretariat

28 June 2006 - Romina Picolotti, president and founder of the Center for Human Rights and the Environment (CEDHA) and active participant in the International Network for Environmental Compliance and Enforcement (INECE), has been appointed as the new head of Argentina's Environmental Secretariat.

The nomination was preceded by President Néstor Kirchner’s announcement of his intentions to prioritize environmental protection in Argentina and to elevate the status of the Environmental Secretariat, which is currently part of the Ministry of Health, to the ministry level in its own right.

Next week, Ms.  Picolotti, an environmental lawyer and human rights activist, will be sworn in by President Kirchner and announce her team and action plan for the next year. The plan will emphasize the relationship between environmental protection and human rights, and will promote public participation and access to information.

She will also seek alliances with the private sector, emphasizing the promotion of cleaner production and the modernization of Argentina’s most contaminating industries, which will ultimately benefit those most affected by environmental degradation.

Durwood Zaelke, Director of the INECE Secretariat, expressed his support for Ms. Picolotti's nomination, stating, "I congratulate President Kirchner for demonstrating his strong commitment to increasing environmental protection in Argentina through his selection of Romina Picolotti, a strong advocate for improving the environmental condition for all of Argentina's people."

In 1999, Romina Picolotti founded CEDHA, the world’s first organization solely dedicated to promoting and protecting human rights violated by environmental destruction. CEDHA aims to contribute to sustainable development by illustrating the symbiotic relationship between people and nature. Ms. Picolotti received the 2006 Sophie Prize in recognition of her dedication to protecting human rights, the environment, and democracy, and her work to relate the degradation of natural resources to the exploitation of human rights.

INECE Announces the the Appointment of INECE Executive Planning Committee Member Antonio Benjamin to the Brazilian Supreme Court (STJ)

28 June 2006 - Antonio Herman Benjamin, founder of the Brazilian NGO Instituto O Direito por Um Planeta Verde and Co-chair of INECE’s Executive Planning Committee, has been appointed by President Luiz Inacio Lula da Silva to become a Justice on the Supreme Court (Superior Tribunal de Justiça) of Brazil.

Brazil has two highest federal courts, the Constitutional Court (STF) and the Supreme Court (STJ), whose Justices are appointed by the President and approved by the Federal Senate, which will hold confirmation hearings on Professor Benjamin next week. His inauguration is expected to take place on the second week of August.

"Through his work with INECE, Antonio has repeatedly demonstrated his commitment to strengthening environmental compliance, the rule of law, and good governance. I commend President Lula for nominating of one of the world's most brilliant legal minds to serve on Brazil's highest court," said Durwood Zaelke, Director of the INECE Secretariat.

Mr. Benjamin has been a tireless advocate of INECE's work, promoting the results of INECE products, such as the Principles of Environmental Enforcement and INECE Indicators, to new audiences, including prosecutors and members of the judiciary. Mr. Benjamin has provided key contributions to setting INECE's agenda for the next three years through his participation in the revision process for INECE's Strategic Implementation Plan.

Mr. Benjamin teaches Environmental Law and Products Liability in both Brazil and the United States; founded and serves as Coeditor-In-Chief of the Brazilian Environmental Law Journal; and has drafted or co-drafted several Brazilian laws, including the 1998 Crimes against the Environment Act, the Forest Code, and the Anti-Corruption Act.

INECE to Promote Environmental Compliance and Enforcement Indicators in Asia

13 June 2006 - INECE and the US Environmental Protection Agency are co-presenting three two-day long capacity building events on environmental compliance and enforcement indicators in Vietnam, Thailand, and the Philippines in June 2006.

Course instructors will work with senior environmental officials in each of the three countries to design practical sets of indicators and establish appropriate methodologies for implementation.

INECE Hosts Expert Meeting on Information Technology to Support Monitoring, Reporting, and Verification in Emissions Trading Systems
 

30 May 2006 - INECE and the International Emissions Trading Association (IETA) held the "Emissions Trading Workshop: One Step Further Towards Compliance" on 29 May 2006 in Brussels, Belgium. The goal of the workshop was to develop an action plan for the IT-based system for monitoring, reporting, and verification and other functions in the European Union Emissions Trading Scheme (EU ETS) that includes functional design, timeline, responsibilities, partners and stakeholders. Participants agreed to meet again in June to further define the functionalities of an IT system and to secure commitments from government stakeholders. INECE Requests International Community to Support Threatened Philippine Environmental Activist
 

Antonio Oposa17 April 2006 - Philippine environmental activist Antonio Oposa, Jr.’s life is in grave danger after a series of death threats and last week’s brutal murder of one of his closest colleagues.

Mr. Oposa is one of the Philippines’ most daring and effective environmental heroes, winning landmark cases before the Supreme Court, organizing highly publicized raids against illegal fishing and logging cartels, and educating scores of local communities on sustainable uses of natural resources.

Mr. Oposa and his colleagues – a broad, informal alliance of government officials, lawyers, police, coast guard, policymakers, judges, scientists, and others – have earned national and international acclaim for their efforts to protect the Visayan Sea, one of the most biologically diverse “hotspots” in the world.

INECE Presents Water Governance Capacity Building Program at 4th World Water Forum
  World Water Forum logo20 March - INECE presented a capacity building program on "Compliance and Enforcement and Legal Aspects of Good Water Governance" on 17-18 March 2006 as part of the Institute@WWF4. The capacity building program introduced participants to environmental compliance and enforcement aspects of good water governance, including developing enforceable requirements, ensuring compliance with those requirements through mandatory and incentive programs, the role of the public, conducting inspections, and creating an atmosphere of deterrence.
INECE Co-hosts Workshop on Emissions Trading
  1 March - INECE and the International Emissions Trading Association (IETA) hosted a workshop "Information Technology Platform for Consistent, Transparent and Efficient Monitoring, Reporting and Verification" in emissions trading systems on 24 February 2006 in Brussels, Belgium. INECE Announces the Launch of the Network for Environmental Compliance and Enforcement in the Maghreb (NECEMA)

  NECEMA logo18 February - On 20-21 February 2006, 100 participants from the Maghreb region and other parts of the world met in Rabat, Morocco, to share experiences and build capacity for the role of municipalities in enforcing environmental laws during the Conférence Maghrébine sur le rôle et les responsabilités des collectivités locales en matière de respect et d’application des lois environnementales. The Conference was hosted by the Moroccan Ministry of the Environment (Ministre chargé de l'Aménagement du Territoire, de l’Eau et de l'Environnement) and sponsored by GTZ.   20 February - INECE developed and released An Introduction to Environmental Compliance & Enforcement Indicators. PDF icon The draft Brochure discusses what indicators are and why they are important and outlines the types of support needed from senior management to implement such a program.
UNEP Hosts High-Level Meeting on Compliance with and Enforcement of Multilateral Environmental Agreements
  1 February - The High-Level Meeting on Compliance with and Enforcement of Multilateral Environmental Agreements (MEAs) met in Colombo, Sri Lanka, from 21-22 January 2006. Approximately 30 experts gathered at this meeting organized by the United Nations Environment Programme (UNEP), with the objective of envisioning the next steps for MEA compliance and enforcement. INECE Working with IUCN, UNEP on Designing Compliance and Enforcement Colloquium
  10 December - The INECE Secretariat met with IUCN and UNEP this week to continue collaboration on the 2006 IUCN Academy of Environmental Law Colloquium "Implementing Environmental Legislation: The Critical Role of Enforcement and Compliance." 

The Colloquium, to be held from 16-20 October 2006 at Pace University School of Law in White Plains, New York, will build upon the October 2005 INECE Environmental Compliance and Enforcement Workshop to Establish a Research Agenda.  

The Colloquium will focus upon compliance and enforcement subjects such as:  the relationship to rule of law and sustainable development; strengthening implementation of multilateral environmental agreements; drivers of compliance; instruments and approaches; the role of the public; measuring progress with indicators; and improving the methodology and empirical basis of compliance research.

Experts Confirm Compliance Key to Emission Trading Success
  18 November - INECE convened a workshop on "Confidence Through Compliance in Emissions Trading Markets," along with co-sponsors Environment Agency (England & Wales), VROM, the European Commission, the U.S. Environmental Protection Agency, Resources for the Future, and American University's Washington College of Law. The expert-level discussion focused on good practices for monitoring, reporting, and verification in emission trading systems. The workshop background paper, along with copies of presentations and speaker biographies, are available on INECE's Web site at http://inece.org/emissions/.
INECE Convenes Workshop on Research Agenda in Santa Barbara, CA

1 November - On 21-22 October, INECE gathered a select group of ECE practitioners and academics at the Bren School of Environmental Science & Management (University of California, Santa Barbara) for a workshop on establishing a research agenda for the academic community that will further the efforts of practitioners. 

This workshop bridging the two communities produced several important topics for research concerning how to generate compliance, why compliance occurs, how to measure the effect of compliance efforts, and what makes networks effective.  Workshop participants recommended next steps for narrowing the list of topics, distributing them to the research community, and getting results from the research

INECE and Law for a Green Planet Institute Host Workshop to Plan an Enforcement Cooperation Project on Illegal Logging in the Amazon
  30 August - Participants from INECE, Law for a Green Planet, the Brazil Ministry of the Environment (MMA), the Brazil Environmental Agency (IBAMA), the State Court of Amapá, the Sociedad Peruana Derecho Ambiental, IMAZON, and the U.S. Embassy discussed general guidelines for an enforcement cooperation project, including a seminar to build enforcement capacity against illegal logging and deforestation in the Amazon. Participants agreed that the seminar will take place in Amapá, Brazil, on August 2006. The target of this seminar will be judges, public prosecutors, lawyers from IBAMA, and lawyers from state environmental agencies. The seminar will focus on training with multidisciplinary approach. Launching a New Asian Environmental Compliance and Enforcement Network

27 July - INECE, the Asian Development Bank, the United States Agency for International Development (USAID), theAECEN logo Philippine Department of Environment and Natural Resources will hold a workshop on 2-3 August 2005 to formally launch the Asian Environmental Compliance and Enforcement Network (AECEN) and develop the network's programs and activities. The workshop will bring together over 80 environment officials, judges, lawyers, and civil society leaders from 13 Asian countries. A training workshop for senior Asian environmental officials on developing and implementing environmental compliance and enforcement indicators will be held on 4 August 2005, subsequent to the regional meeting.

AECEN developed and launched a Web site, hosted on the INECE site, at http://www.inece.org/aecen/ to present the Asian Network's goals, activities, and other information.

INECE Concludes First e-dialogue on ECE Indicators
  10 September - The International Network for Environmental Compliance and Enforcement concluded its first e-dialogue, "Good Practices for Identifying Environmental Compliance and Enforcement Indicators" on 09 September. The e-dialogue was moderated by Mike Stahl, Director of Compliance, US Environmental Protection Agency. 62 people registered and monitoring the e-dialogue, and there were 19 participants who posted comments over these last three weeks. INECE Prepares for Upcoming Executive Planning Committee Meeting
  24 May 2004 - The first 2004 meeting of the INECE Executive Planning Committee will be held on 17-18 June in Montreal, Canada at the Offices of the Commission for Environmental Cooperation. EPC Members will discuss progress towards achieving INECE's Strategic Implementation Plan and strengthening plans for the 7th Conference, which is scheduled to be held in Spring 2005 in Morocco.

15 March 2004 -On 26 April 2004, the Law for a Green Planet Institute will sponsor a course on the Responsibilities of Companies and the State for Environmental Damage (Curso: Responsabilidade da Empresa e do Estado Pelo Dano Ambiental: Aspectos Civis, Administrativos, e Penais) in São Paulo, Brazil. (en português) The course intends to discuss the general legal theory of environmental liability and case studies. It focus mainly on civil, administrative and criminal liability. It also covers negotiation and implementation of settlements and prevention of environmental damage. The speakers are the leading experts on environmental law of Brazil.

INECE and OECD Team to Strengthen Environmental Compliance and Enforcement

The Fifteenth Meeting of the Parties to the Montreal Protocol, Illegal Trade in CFCs
  November 10, 2003 - The 15th MOP is being held in Nairobi, Kenya on November 10 - 14, 2003. On November 10, the Environmental Investigation Agency (EIA) held a press conference regarding illegal trade in CFCs. EIA panel members presented a report entitled "Global CFC Smuggling Trends and the Need for a Faster Phase-out." IISD Linkages report on MOP-15 are available on their Web site.

Shared Spaces Explores Environmental Enforcement
  shared spaces - VROM online magazine October 7, 2003 - Shared Spaces - an initiative of the Dutch Ministry of the Environment, Housing and Spatial Planning (VROM) - is an international, online forum for sharing ideas and opinions. The most recent edition includes contributions from Gerard Wolters, the Inspector General of the Netherlands, Durwood Zaelke, INECE Director, and features a discussion between Thomas Sansonetti, Assistant US Attorney General, and Catherine Day, Director General of Environment for the EU. The magazine also features enforcement perspectives from Costa Rica, Lithuania, The Philippines, and the United Kingdom.

Upcoming Indicators Workshop
  August 25, 2003 - INECE and OECD will co-host a workshop on Environmental Compliance and Enforcement Indicators, which will be held on November 3-4, 2003 in Paris, France at OECD. The Workshop, which is by invitation only, is designed to result in two primary outcomes: (1) agreement on a common framework for the development of environmental compliance and enforcement indicators with consideration of regional and country-specific needs, and (2) methodology for the development and implementation of pilot projects to test indicators at the country level. Guiding Principles for Reform of Environmental Enforcement Authorities in Transition Economies of Eastern Europe, Caucasus and Central Asia adopted at the Ministerial Meeting in Kiev
  Image of Guiding Principles Publication.August 8, 2003 - Environmental Ministers from the whole Europe, the US and Canada in their Declaration adopted at the Conference in May 2003 in Kiev, Ukraine adopted "Guiding Principles for Reform of Environmental Enforcement Authorities in Transition Economies of Eastern Europe, Caucasus and Central Asia (EECCA)" PDF document - please download Adobe Acrobat as a basis for true institutional restructuring and rebuilding enforcement and compliance assurance systems following the crisis that touched the region in the 1990s. Despite major changes in social and economic conditions following the disintegration of the Soviet Union environmental inspectorates in the newly independent states continued to replicate the "centrally planned" model that included maintaining the authoritarian culture, inconsistent and discretionary enforcement, and unchanged arsenal of enforcement instruments. Creating deterrence and changing the behaviour of the regulated community were neglected. The inspectorates were deprived of considerable authorities as well as of adequate human and financial resources. Their situation has been even more aggravated by very frequent organisational reforms that occurred without having improved the methods of operation. All these factors led to a loss of integrity and credibility and lack of effectiveness.

The "Guiding Principles" represent a non-binding reference that aims at helping governments to identify key features of an effective and efficient system of environmental enforcement and to create a framework for international co-operation and support. The NISECEN, within which the Guiding Principles were developed, provides its Members with the opportunity to learn good international practices, develop new reference models and tools, and apply them. In addition, a number of specific tools have been developed to support the implementation of the Guiding Principles, including a review of enforcement, permitting and compliance promotion systems, training toolkit, and the glossary of terms. The Network will continue pursuing its goals with its new work programme will be discussed at the Fifth Annual Network Meeting on 16-18 October 2003 in Kiev. New World Resource Institute Publication Addresses Good Environmental Governance
 

August 4, 2003 - The latest report in the World Resources series, Decisions for the Earth - Balance, Voice, and Power, focuses on the importance of good environmental governance by exploring how citizens, government managers and business owners can foster better environmental decisions that meet the needs of people and ecosystems with equity and balance. The report argues that greater transparency and accountability can lead to fairer and more effective management of natural resources. It calls on governments to include the public in decisions that affect ecosystems and urges integration of environmental impacts into economic decision-making. It also identifies public access to information from governments, business, and non-governmental organizations as a necessary precursor to improved environmental performance. View press release here. Judges of Central/Eastern Europe, Caucuses and Central Asia Meet, Release Lviv Declaration
 

July 3, 2003 - In May, senior judges from 11 countries of Central/Eastern Europe, Caucasus and Central Asia, together with other judges and experts from across the globe, met in Lviv, Ukraine to advance the Johannesburg Plan of Implementation, insofar as it relates to the role of the judiciary in achieving sustainable development. The conference program considered regional and comparative case studies, together with issues relating to the Aarhus Convention, human rights and environment, constitutional environmental rights, the potential role of specialist environment courts, and the ability of judges to exchange judgments through the IUCN/UNEP Judicial Portal. The Rome Statement PDF document - please download Adobe Acrobat was released in May following a meeting of European Judges in May to discuss the Johannesburg Plan of Implementation. Specific outcomes included the first meeting of the European Judges Forum and the IUCN CEL Judicial Specialist Group, further support for the IUCN/UNEP Judicial Portal and consideration of the content of the UNEP Judges Handbook.

New Publication on International Environmental Crime

INECE Releases Spanish Translation of Environmental Inspection Guide
  April 1, 2003 - The Spanish translation of Conducting Environmental Compliance Inspections: Inspectors Field Manual - International Edition (Inspecciónes de Cumplimiento Ambiental: Manual de Campo del Inspector - Edición Centroamericano" Adobe PDF Icon) is now available through the INECE Web site. The manual provides participants with an approach for effectively conducting environmental compliance inspections and becoming involved in the environmental compliance review and the resolution of any violations found.
New INECE Guide to to Citizen Suits and Access to Justice
  March 27, 2003 - INECE has developed a resource guide to Web sites address Citizen Suits and Access to Justice issues to complement our Public Access to Information Forum. The guide provides links to international NGOs working on citizen suits/justice issues, as well as resources for many countries (local/regional NGOs, laws, case studies and analyses, and government resources.
Guiding Principles to Reform the Environmental Enforcement Authorities in Transition Economies of Eastern Europe, Caucasus and Central Asia
 

March 18, 2003 - In October 2002, the NIS Environmental Compliance and Enforcement Network (NISECEN) agreed to use the Guiding Principles as a non-binding guidance. The policy document helps to distinguish key features of an effective system of environmental enforcement and presents a long-term vision for institutional development. Recently, the representatives of environmental ministries and international institutions that are part of the "Environment for Europe" process endorsed the Guiding Principles during the Meeting of the EAP Task Force (February 2003). They recommended that the Guiding Principles enter into the package of Category 1 documents at the Kiev Ministerial Conference, to be held in May 2003. The Ministerial Declaration is likely to welcome the implementation of these principles.

  February 10, 2003 - INECE is currently developing a sub-forum for Pesticide Stakeholders in Central America, which is now available online. The forum, a result of a workshop at the 6th International Conference, features information resources specific to the Central American region. INECE encourages you to submit comments and suggestions for inclusion to the Office of the INECE Secretariat.
ELI Report: Uniting to Enforce for Better Results

January 8, 2003 - Uniting to Enforce for Better Results (pdf, 128KB), written by EPC member Bill Futrell, was published in The Environmental Forum, the Policy Journal of the Environmental Law Institute (Volume 19, No. 6). Futrell's article informs officials worldwide of the role of INECE in effective environmental compliance and enforcement.

Czech Minister of the Environment Addresses International Network - A Report from the Annual EPC Meeting
  Prague at Night18 October, 2002 - Prague, Czech Republic - Twenty members of the Executive Planning Committee (EPC) for INECE (International Network for Compliance and Enforcement) met today and yesterday at the Czech Environmental Inspectorate to discuss the need to strengthen environmental compliance and enforcement globally.
